Abstract:

With continuous standardization of reproductive medicine institutions，the ethics and regulations as well as management of assisted reproductive technology and sperm bank are gradually established，with strong government dominance.The corresponding ethical principles，administrative rules and management system have been established primarily at present.But some original regulations have to be revised due to the rapid development and constantly expanding scale of assisted reproductive technology and there has to be new regulations and rules to solve new problems.It is advised to normalize the practice and behavior of related personnel including patients on a broader level for the reason that the old regulations and rules are usually not so appropriate.In conclusion，we had better make inventions and innovations to promote the development of assisted reproductive legislation to higher level.

摘要：

中国辅助生殖和精子库技术的伦理与法规及管理是伴随着对生殖医学机构不断进行规范化的过程中逐渐建立起来的，有很强的政府主导性。目前，已经基本建立起了相应的伦理原则、部门规章及管理制度。但是由于辅助生殖技术发展迅速，规模不断扩大，一些原有规章需要修订，针对新出现的问题要有新的管理办法和规定，且过去的规定和办法层级较低，不利于在更广泛的层面上规范相关人员包括患者的做法和行为，应创造条件，推动辅助生殖立法向高层级发展。
