试论外科临床路径的法律价值

摘要：

外科临床路径是指针对外科系统某一疾病在总结前人成熟技术和成熟经验的基础上，建立的一套标准化流程、路线，从而起到规范医疗收费、指引医生诊疗行为、监控医院质量、加强医院管理等作用。外科临床路径属于临床路径的一部分，由此，笔者针对临床路径的作用、法律地位以及其违反该路径的法律责任等方面进行分析，试图阐释临床路径的法律价值。

Abstract    Surgical clinical pathway refers to that setting up a standard flow or a pathway on the basic of surgical technology and experience to treat some desease, as to regulating medical payment standar, guding medical behavior, monitoring medical quality, enhancing hospital management and some other functions. Surgical clinical pathway is a part of clinical pathway, from which the author would anylize the functions, legal status, legal responsbility of clinical pathway. And also try to elaborate the legal value of clinical pathway.
